Since the beginning of 2011, there is much uncertainty for most Americans in the area of estate planning and asset protection. For much of 2010, we expected 2011 to greet us with a 55 percent estate tax on all assets over $1 million. Yet by the end of 2010, President Obama gave in to Republican demands of a reprieve on this exorbitantly high death tax and agreed to reduce the estate tax for 2011 and 2012 to 35 percent, with a $5 million exemption amount.

If you plan on living well past 2012, uncertainty still remains, however. As of today, the estate tax rate for 2013 will revert to 55 percent, with only a $1 million exemption amount. We will hope for the best but must plan for the worst, which is why many people decide to set up Irrevocable Life Insurance Trusts for all life insurance policies over $250,000 and Bypass trusts for all marital estates over $2 million.

The world of asset protection was turned slightly on its head as well in 2010. On June 24, 2010, the Florida Supreme Court issued its long-awaited opinion in the case of Shaun Olmstead, et al., v. The Federal Trade Commission and raised the question as to whether Florida limited liability companies (LLCs) will continue to have charging order protection. A charging order is a remedy that a creditor of a member in an LLC can receive from a court that instructs the entity to give the creditor any distributions that would otherwise be paid to the partner or member from the entity. Generally, a creditor who receives a charging order with respect to a member’s interest in the entity does not have any authority to mandate distributions from the entity or to participate in the management and affairs of the entity, nor are they able to access the assets of the company.

Charging orders are governed by state law, and in many states, a charging order is the exclusive remedy for a creditor with respect to a debtor’s LLC membership. However, the Olmstead ruling allowed the creditor to “pierce the corporate veil” of the LLC and access the actual assets of the LLC. While the LLC at issue in Olmstead was a single-member LLC, many attorneys are concerned about the slippery slope that would allow the piercing of multiple-member LLC’s as well. This is definitely worthy of tracking for the next several months.

It’s become practically an expected social norm these days to live next to someone for years and never get to know them, and in many cases never even learn their names. However there are a lot of advantages of getting to know who your neighbors are. For starters, you will naturally feel more secure and comfortable if you have at least met your immediate neighbors. After all, they are the people closest to your home and getting to know them can be beneficial. If there is ever suspicious behavior around your home, your neighbors will be the first to see and will more readily contact you if you have a relationship with them.

If you have children, getting to know your neighbors is also very important. Neighbors can be good watchmen for your kids, because you cannot always be everywhere your kids are. Your children will likely play with the neighborhood kids and you’ll feel more safe and confident knowing the parents of your neighborhood children, and as well as, knowing the children themselves.

The opinions and actions of community members can affect change in a neighborhood. If there are common concerns, you’ll feel more comfortable addressing these issues with your neighbors if you have an established relationship with them. If issues arise later on, such as wanting to start a neighborhood watch, for instance, people will be more receptive if they already know who you are.

Traditionally, neighbors were people you could trust with the key to your home and with your kids and they provided a great support system for your family. Today, people are more protective and less trusting, and it’s not difficult to see why. It undoubtably will be awkward to cross paths with someone day in and day out without speaking. This is when fear of the unknown sets in and people begin to feel uncomfortable. Even if you and your neighbors do not become the best of friends, having good rapport will make your life a lot easier and more comfortable. So get it on your to-do list, to take some time out and start getting to know at least your closest neighbors, no matter how long you’ve lived in your neighborhood.

Even with the increase in public awareness campaigns and commercial advertising by product manufacturers over the past few years, millions of home owners are still not aware of how many toxic chemicals may be in their home right now.

“Since 1950 at least 70,000 new chemical compounds have been invented and dispersed into our environment. Only a fraction of these have been tested for human toxicity. We are, by default, conducting a massive clinical toxicology trial, and our children and their children are the experimental animals,” say Herbert L. Needleman, M.D. and Philip J. Landrigan, M.D., authors of Raising Children Toxic Free.

“Of these 70,000 chemical compounds, only 25% have been tested – and they were tested individually. Chemicals do not occur individually in our body, they occur in combinations. Tiny amounts of only 2 toxic chemicals at the same time are 1,000 times more dangerous than 1 of them alone,” according to The Center of Bio Environmental Research.

The surprising fact is how at risk we truly are inside our own homes. “The nation’s worst pollution is found inside our homes. A 15-year study has shown American homes can have chemical levels as much as 70 times higher than outside the home. According to the The Environmental Protection Agency (EPA), the number of chemicals used inside the home has more than doubled since 1950.”

It is important to note that the following is only a small glimpse of the products containing these chemicals. These include dishwashing detergents, household cleaners, disinfectants, furniture polish, air fresheners, fabric softeners, bleach products, mold/mildew cleaners and shampoos, just to name several of the more common ones in use today.

We become poisoned by ingestion, inhalation and absorption through the skin. “Some products release contaminants into the air right away; others do so gradually over a long period of time. Some stay in the air up to a year,” according to the American Lung Association.

All of this results in poor health and less vitality than we would normally have in a fresh, healthy environment. According to a State of Massachusetts Study (1989), “As much as 50% of all illness is due to poor indoor air quality.”

The red flags of this toxic crisis are staggering.

- One in every 3 now get cancer. “Women who work in the home have a 55% higher death rate from cancer than women who work outside the home,” according to a 17-year EPA Study. Further results show that “Asthma rate has tripled in the last 20 years.”
- “Incidence of lung cancer has increased 364% despite the fact that smoking has declined in the general population,” according to The National Cancer Institute.

WHAT SHOULD WE DO?

“Damage to organs caused by environmental chemicals frequently cannot be repaired or corrected once the injury has occurred. PREVENTION, is therefore essential,” say Herbert L. Needleman, M.D. and Philip J. Landrigan, M.D., in their book Raising Children Toxic Free.

“Just by reducing (not eliminating) environmental carcinogens alone, we would save at least 50,000 lives taken annually by cancer,” said Dr. Lee Davis, former advisor to the Secretary of Health.

Some well-known brands include ecover, Earth Friendly Products and Seventh Generation. All of these tend to be better than the home “recipes” as they typically clean much better and can sanitize. These cleaners are formulated with surfactants which can remove grease and oil, mildew and mold. If you are not having your products delivered to your door, you sometimes need to search for them or get them at a few different stores, but they are available. You may need to go to your local health food store.
